CONSTITUTIONAL RIGHTS

An individual who believes that his or her constitutional rights have been violated can bring a civil action against a defendant or defendants to recover the damages sustained as a result of that violation.  For example, constitutional rights include freedom of speech, freedom of the press and the right to a free market.  If someone attempts to stop another person from exercising his or her constitutional rights, then this is a possible violation, and is deemed unconstitutional.  Constitutional violations can be filed against the government, an individual or a group.  A constitutional tort is an action that violates the Constitution and provides a remedy for plaintiffs who have been deprived of rights, privileges, or immunities granted by the Constitution or federal law.

One example of a constitutional tort is a violation of one’s due process rights.  We argued a case on behalf of our client who was expelled from a university, under Title 9 law, due to allegations brought on by another student who claimed our client sexually assaulted her.  Our client was expelled from the university without any hearing or due process.  Marino Associates understands the harmful long term impact violations to one’s constitutional rights may have on individuals and the need to fight with legal skill and fortitude.
