DRAM SHOP / OVER-SERVED ALCOHOL

According to Pennsylvania’s Dram Shop Law, any establishment or licensed individual who gives alcohol to a visibly intoxicated person can be legally held responsible for injuries and damages that person might fall victim to. The law includes bars, restaurants and private events. There are many tragic instances where Dram Shop Laws apply. A successful Dram Shop lawsuit must prove that an employee or agent of an establishment, or host of an event, served alcohol to a visibly intoxicated person who was injured as a direct result of the decision to serve the visibly intoxicated person. Establishing credible witnesses is critical to a Dram Shop suit.

Twenty one (21) years-old client, along with friends, was a patron of a bar and purchased alcohol.  While a patron of the bar, the client was served alcohol after presenting visibly signs of intoxication.  Upon leaving the bar, as a result of excessive consumption of alcohol, the client unknowingly meandered from the shoulder of the highway onto the surface of the Pennsylvania Turnpike and was struck by a passing motor vehicle traveling at a high rate of speed.  After the impact of the striking motor vehicle with the body of the client, the client laid on the side of the highway profoundly injured and profusely bleeding until rescued approximately seven (7) hours later.  Suit was initiated on behalf of the client asserting a Dram Shop Act violation.  The action resulted in a sizeable settlement on behalf of the client.
