Defamation lawsuit filed by former Penn State trustee now moved to federal court

Fenchak’s attorney Steven Marino believes, Defendants Pennsylvania State University, Matthew Schuyler, and David Kleppinger individually and through representatives, retaliated against my client, Barry Fenchak, as a result of the my client’s exercise of protected speech guaranteed by the First Amendment of the United States Constitution and Article 1, Section 7 of the Pennsylvania Constitution.

Barry Fenchick Defamation Lawsuit against Penn State University and Board of Trustees Matthew Schuler, and David Kleppinger

University Park, PA (WJAC) — A former Penn State trustee’s defamation lawsuit against the university and trustee leadership is now in federal court.

Barry Fenchak’s suit was first filed, earlier this month, in the Philadelphia Court of Common Pleas.

But a few days later, the lawsuit was transferred to the Federal District Court of Eastern Pennsylvania.

Fenchak claims that his Constitutional rights were violated and false claims were made about him, after he first requested financial information about Penn State’s endowment fund, along with an athletic department contract.
